These Terms and Conditions contain details of the Licence that AtoBviaC Plc (“The Company”) is willing to grant to you in respect of your use of the information available in general on the AtoBviaC Online website (“The Information”).

Please read this document carefully, your use of The Information is governed by these conditions.

LICENCE AGREEMENT AND LIMITED WARRANTY

1. Licence restrictions

1.1 You may not nor permit others to:

(a) translate, reverse engineer, decompile, disassemble, merge, modify or create derivative works based on The Information except as permitted by law;

(b) vary, delete or obscure any notices of proprietary rights or any product identification or restrictions in The Information.

2. Fair Usage Policy

Whilst we do not impose a formal restriction on the amount of use of the information and systems provided, we do operate a Fair Usage Policy and believe that users of the system should be able to use the services provided in an appropriate manner to meet their commercial needs and decision making processes.  In the event that we consider use of the system to be excessive, we may consider suspending use of the services offered.

3. Disclaimer

The Company excludes and expressly disclaims all warranties and conditions not stated in this Agreement including, but not limited to, any implied warranties of quality, merchantability, fitness for a particular purpose or ability to achieve a particular result. You assume the entire risk as to the quality and performance of The Information. The Company does not warrant that The Information will meet your requirements or that its operation will be uninterrupted or error free.

4. Limitation of liability

Your attention is specifically drawn to this clause 3.

3.1 The Company’s liability in respect of damage to your tangible property resulting from the negligence of the Company shall be limited to the sum for which the Company carries comprehensive insurance cover.

3.2 Save as provided above, in no event will the Company be liable to you for any damages, including any lost profits, lost savings, loss of data or any indirect, special, incidental or consequential damages arising out of the use of or inability to use The Information, even if the Company has been advised of the possibility of such damages.

3.3 While The Information has compiled with best endeavours using the best resources currently available, it should be used at your own risk. No warranties or representations are given nor is any duty of care or responsibility accepted by BP, BP Shipping Limited or the company or by their respective directors, officers or employees or by any person, firm, company or organisation who or which has been in any way concerned with the furnishing of information or data, the compilation or any translation, publishing, supply of The Information, for the accuracy of any of The Information or any omission from The Information or for any consequence whatsoever resulting directly or indirectly from use of, or reliance on any of The Information even if caused by failure to exercise reasonable care.

3.4 You acknowledge and agree that the limitations contained in these Terms and Conditions are reasonable in light of all the circumstances and you agree that the Company would not be able to provide The Information on an economic basis without such limitations.
